LEGISLATION

CALIFORNIA
SB 1192 – The Reclaim Act Purpose: Protecting Survivors from Litigation Abuse in California CourtsLead Author: Senator Susan Rubio (District 22)Bill Sponsored By: the California Partnership to End Domestic Violence Session: 2025-2026
OverviewSB 1192, the Reclaim Act, addresses a critical gap in California’s legal system: the use of litigation as a tool of continued abuse. Survivors of domestic violence often face ongoing harassment, intimidation, and financial harm through repeated lawsuits, excessive discovery, and court manipulation. This bill creates a clear, enforceable process to stop that pattern while preserving legitimate access to the courts.

NEW YORK
The CREEP Act (S3394A / A3226A)Purpose: Protecting Victims from Digital Stalking and Online Coercive Control in New YorkLead Sponsors: Senator Andrew Gounardes (District 26) Supported By: Safe Horizon; Joyful Heart Foundation; RAINN; C.A. Goldberg, PLLC; and Brooklyn District Attorney Eric Gonzalez Session: 2025-2026
OverviewThe CREEP Act (S3394A / A3226A) addresses a critical gap in New York law: the failure to adequately recognize and respond to digital stalking as a form of coercive control and a precursor to escalating violence.
As abuse increasingly occurs online, existing legal frameworks have not kept pace. This legislation strengthens definitions, enforcement, and accountability, ensuring victims of digital stalking receive protection before harm escalates.

PETITIONS

Coercive Control Click here to sign the petition In an effort to bring awareness to the dangers of coercive control, this petition has been created demanding congress pass victim focused legislation by mandating all first responders including police officers and detectives as well as judges, attorneys, therapist, doctors, nurses, and teachers are trauma informed and properly trained to look for signs of coercive control behaviors that are demonstrated by both the victims AND the perpetrators. This legislation will also need to give law enforcement and judges the authority to take necessary action to detain and or restrain the perpetrator even if there are no visible signs of physical injury.
Litigation Abuse
Legislation In process (SB 1192 - The Reclaim Act)Remove loopholes from defamation laws to protect victims of abuse right to freedom of speech and preventing perpetrators, alleged or otherwise, from using the court system to further abuse their victims.
Plea Deals
Petition Pending Remove the ability of DA's to offer plea deals, to avoid the cost of trial in domestic violence cases when the perpetrator has multiple violations of protection orders. Mandatory jail time to be determined based on the number of violations. this will also prevent the cost of trial.
Record Without Consent
Petition Pending Excluding domestic violence cases from record with consent laws. Perpetrators rarely abuse when someone is watching or when they think they are being recorded making it impossible for victims to provide evidence of abuse.
Protected Group Classification
Petition Pending Add domestic violence and abuse victims to the protected group classification to prevent discrimination and harassment in the workplace, on social media platforms and in private and public businesses in civil, family and criminal courts.
Disability Classification Petition Pending Add domestic violence and abuse victims to the list of temporary disability classifications to accept disability payments from the government to help them heal and recover from the trauma caused by the abuse, weather the perpetrator was prosecuted or not.
